TDS due date for payment and returns

What is the due date for payment of TDS? Is the same due date applicable for all types of assessees? Will it vary for salaried and non-salaried cases? These questions are some of the most frequently asked and searched queries. In this post, we will see how the due dates are applicable. 

CBDT extends due date for filing of TDS statement in Form 24Q for financial year 2018-19 from 31st of May, 2019 to 30th of June, 2019. Also, the due date for issuing of TDS certificate in Form 16 for financial year 2018-19 has been extended from 15th of June, 2019 to 10th of July, 2019.

The due dates for the payment of the deducted TDS are on or before 7th of next month. That is, if the deductor has to pay the TDS of November, then he has to pay it on or before 7th of December.

  • These due dates are applicable to all non-Government assesses and also to Government assessees who deposit tax with Challan. 
  • For government assessees who do not make the payment with challan, the due date for payment of TDS will be the same day on which the amount is deducted.

Next, we will see the Due date for filing of TDS returns. Before that we will get a general idea about which forms are applicable to different cases: 

  • Form 24Q: It is the TDS quarterly return to be filled out by the deductor ( or employer) for all the deductions made in a salaried case.
  • Form 26Q: It is the TDS quarterly return to be filled out by the deductor for all the deductions made in the non-salaried case.
  • Form 27Q: It is the TDS quarterly return to be filled out by the deductor for all the deductions made in the case of NRIs.
  • Form 27EQ: It is the TCS quarterly return to be filled out by the deductor.

Late payment and filing consequences:

Fees for delay in deduction: In the case when the TDS is not deducted on the specific due date ( Deduction due date is 30th of the month and in case of February, the last day of the month), then interest will be applicable at a rate of 1% per month from the date when it should have been deducted. 

  • Example: If the TDS amount was to be deducted for the month of May (i.e, on 30th of May), but it was actually deducted on 10th of June then interest will be 2% (for the month of May and June).

Fees for delay in payment of deducted amount: In the case when the TDS deducted on time but is not paid by the specific due date ( payment due date is 7th of next month and in case of March, it is 30th of April), then interest will be applicable at a rate of 1.5% per month from the date when it should have been paid. 

  • Example: If the TDS amount was to be paid for the month of November (i.e, on or before 7th of December), but it was paid on 10th of December then interest will be 3% (for the month of November and December).

Fees for the delay in furnishing the statements: In such cases where there is a delay in furnishing the eTDS statement, a mandatory fee of Rs. 200 per day will be applicable. The total fees should not exceed the total TDS amount of that quarter. The late filing fee should be paid before filing such delayed eTDS statement. 

Failure to file eTDS statement delaying more than a year or furnishing incorrect details in the statement filed like PAN, Challan and TDS Amount etc, will result in a penalty ranging from Rs. 10,000 to one lakh.

    Dear Sir,
    From the TDS due dates given I see that there has been change in the due date for March. Earlier it was 7th April for the liabilities accounted for between 1st and 30th March and also for salary for the month of March, whereas it was 30th April only for the liabilities accounted for on 31st March.

      Mr. Gupta,

      The law enumerated above is applicable/in force for last many years.

      Any tds deducted in March can be deposited till April 30th. No difference if it is deducted on 1st or 31st day of March.

        Hi Sir,

        I deposit the TDS( Interest-94A) of Q1 (A.Y. 2017-18) timely but forgot to filed the return. How much penalty i have to pay. Can i covered in u/s 271H ?.TDS Amount is Rs.10,500/-

          Hello Mr. Saurabh Bansal,
          No, you will not cover under 271H, instead you will be levied late filing fee of Rs.200 per day from the Due date (i.e, for Q1 its July 31st) to actual filing date OR Total TDS Payable, whichever is lesser. In the above case the late filing fee will be Rs.10500.

          The late filing fee should be paid through Challan and the challan to be quoted in the return being filed.

            Dear Sir,

            I didn’t pay any amount of interest to party till now. If i do the due entry on 31-march-2017 and paid the remaining TDS. So can i save that penalty.

    I had given 10% of total cost as booking amount to builder on 25 aug 2017 for a ready to move property, and balance payment will be done by bank probably by 20 sept 2017. What should be the tds deposit time line in this case, 7 sept or 7 oct. The bank representative is saying it is 7 sept but my question on that is , since the final amount has’nt been paid how can i deduct the tds on total amount.Please advice

      Dear Sir,
      For TDS payment delay, the rate of interest is 1.5% per month. So for 2 days delay also it is computed as a 2-month delay. Hence, calculate 3% on Tax deducted amount
